To participate in free entry tournaments with credit: You must be at least 13 years old. You agree not to cheat. “Cheating” means (i) using hacks or other inappropriate means to improve your performance in a contest, (ii) engaging in activities relating to a Game that violate our rules posted here, Publisher`s rules or your agreement with Publisher, (iii) misleading or attempting to mislead our skill ranking algorithm; to be placed in a division or to obtain an arcade mission or bounty objective for players whose skill level is lower than your actual skill level in relation to the particular game, including, but not limited to, creating secondary or multiple game accounts or intentionally executing below your actual skill level in games, or (iv) any other attempt, gain an unfair advantage for yourself or any other entrant in a Contest. You and we agree that the American Arbitration Association (“AAA”) will administer the arbitration in accordance with its Commercial Arbitration Rules and the additional procedures for consumer-related disputes in effect at the time the arbitration is initiated (“AAA Rules”). These rules are available at www.adr.org or by calling the AAA at 1-800-778-7879. A party requesting arbitration must provide the other party with a written request for arbitration in accordance with the AAA rules. (The AAA offers a general request for arbitration.) The arbitration shall be conducted individually and by a sole arbitrator. The sole arbitrator will be either a retired judge or an attorney admitted to practice law and will be selected by the parties from the AAA`s roster of arbitrators. If the parties fail to agree on an arbitrator within fourteen (14) days of service of the Request for Arbitration, the AAA will appoint the arbitrator in accordance with the AAA Rules. The arbitrator(s) shall have the right to grant all remedies, including injunctive relief, available in any individual dispute, except for remedies that you validly waive under these Terms. Notwithstanding anything to the contrary in this paragraph, the parties agree that such arbitration will be conducted on an individual basis, but will be dealt with by a panel of three (3) arbitrators, if either party seeks injunctive relief that would materially affect other of our customers or users. In that case, each Party shall elect one arbitrator and the two arbitrators chosen by the Party shall select the third arbitrator to chair the arbitration panel. This chair is a retired judge or a licensed lawyer with experience in arbitration or arbitration of disputes.
In the event of disagreement as to whether the threshold for a panel composed of three arbitrators has been reached, the sole arbitrator appointed in accordance with this Section shall make that decision. If the arbitrator determines that a three-member arbitral tribunal is appropriate, he or she may participate in the arbitral tribunal, if selected by one of the parties or as chairman of the two selected arbitrators.
