Ferrets are illegal in Queensland for reasons similar to those in New Zealand. The difference between New Zealand and Australia is that Australia has a warm climate that is not good for ferrets, and there are predators that can feed on ferrets such as foxes and dingoes. In exercising its power to protect its citizens – with its police power [FN4] – the city is also limited by the constitutional requirement that the sovereign cannot deprive citizens of property without due process. Jacobson v. Massachusetts, 197 U.S. 11, 25, 25 S.Ct. 358, 361, 49 L.Ed. 643 (1905). Where, as in this case, the exercise of police power does not affect fundamental rights such as the right to vote or freedom of expression, we apply the same basic rational analysis used in the constitutional guarantee of equal protection. 307, 312, 96 pp. 2562, 2566, 49 L.Ed.2d 520 (1976). Thus, deprivation of private property due to police violence is constitutionally permissible if the impugned legal act is rationally connected to a legitimate legislative purpose or purpose. Exxon Corp. v. Governor of Maryland, 437 U.S. 117, 98 S.Ct. 2207, 57 L.Ed.2d 91 (1978).
In California, it is illegal to sell, import, transport or keep ferrets as pets unless you have a license from the California Department of Fish and Game. No permit is issued for the possession of a home. They are issued only in special circumstances, for example for medical research or to remove confiscated or rescued ferrets from the state. The national ban is based on concerns that escaped and discarded ferrets could establish unnatural wild populations that would compete with native wildlife and disrupt the ecosystem. Portugal is the only European country where ferret ownership is illegal. The police will arrest you if they see a ferret with you. Officials are not actively looking for ferrets with people, but it is a big problem. You can`t take your ferret outside, walk with it, or take the poor creature to the vet. The only reason ferrets are illegal in Portugal is that you can`t use them for hunting. Many activists in Portugal are trying to legalize ferrets, with little or no success.
But there are countries where ferrets are completely banned and you can`t even think about having a ferret as a pet. The fact is that ferrets really can`t survive on their own in the wild, especially because most of them are kibbled. So it`s really a long way. The applicant does not submit such a study to the Court and does not provide any evidence that any of the abovementioned national animal health organisations were informed of the existence and reliability of such data. The only studies Dr. Hoffman refers to regarding rabies in ferrets, see Hoffman Aff. ¶¶ 67-69, are cited for the thesis that “ferrets rarely, if ever, excrete viruses in their saliva.” However, the applicant does not dispute that those studies were strains of rabies not present in the United States and therefore adduces little evidence to the unqualified, conclusive and complete explanation of ferrets` rabies risk. Rupprecht Aff. ¶ 11. In short, the plaintiff does not dispute the City`s evidence related to one of its most pressing concerns in regulating ferret ownership – namely the dangerous viral shedding time in rabid ferrets – and does not stand in relation to Dr. Hoffman`s claims regarding the dangers posed by rabid ferrets. Finally, New York City has banned ferrets as pets, although New York allows them. In addition, local laws are stricter than state laws in some places, and regulations change regularly. So get specific and up-to-date information from your local government or animal control authority. Ferrets are illegal because there are laws in countries that are more than a hundred years old.
